Binding Arbitration & Waiver of Class Actions

These Terms contain a binding arbitration clause. By using our platforms, you agree that any disputes between you and I AM Power Auto Group will be resolved through individual binding arbitration, and you waive any right to participate in a class action, class arbitration, or representative action. Please read the sections titled “Dispute Resolution & Mandatory Arbitration”, “No Class Actions”, and “No Jury Trial” carefully to understand your rights.

By accessing or using our platforms, you unconditionally accept and agree to these Terms, including our Privacy Policy. We may update these Terms and the Privacy Policy periodically without prior notice. User-Generated Content

Users may submit reviews, comments, images, and other content (“User Content”). By submitting User Content, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, reproduce, and distribute it across any media. You warrant that:

Your content is original and does not infringe on third-party rights.
AI-generated content is fully disclosed as such.
Your content does not contain false, misleading, illegal, or harmful material.

We reserve the right to remove any User Content at our discretion.

Registration & Account Security

To access certain features, you may need to create an account with a username and password. You are responsible for maintaining account security and must notify us immediately of any unauthorized access. You may not create an account on behalf of another individual.

Promotional Offers & Contests

We may run promotions, sweepstakes, and giveaways from time to time. These activities are subject to additional terms disclosed at the time of entry. We reserve the right to modify, suspend, or terminate any promotion at our discretion. Winners may be required to sign release agreements before receiving prizes.

Marketing Communications

By providing your contact details, you agree to receive promotional and non-promotional emails, SMS messages, and other communications. Standard message and data rates may apply. To opt-out, reply with “STOP” to SMS messages or follow the unsubscribe instructions in emails.

Wireless Messaging Services

We do not guarantee that our Message services will be supported by all wireless carriers. You should have a text or SMS-enabled cellphone to receive our messages. Consent is not required to purchase any products or services. We do not guarantee the receipt of all messages, as wireless carriers are not responsible for delayed or undelivered messages. Our Message services may be managed by a third party ("Administrator"), and use of these services is subject to the Administrator’s terms and conditions.

Emails/Newsletters

You may opt out of receiving our emails or newsletters by updating your Direct Marketing Consent settings in your Account or by using the "Unsubscribe" option included in our emails.

A. If you believe any content on our website infringes your copyright, please send a notice to our "Copyright Agent" with the following information:

Your name, address, phone number, and email address.
A description of the copyrighted work that you believe has been infringed.
The exact URL or description of where the alleged infringing content is located.
A statement that you have a good faith belief the disputed use is unauthorized.
Your digital or physical signature or that of someone authorized to act on your behalf.
A statement that the information is correct and that you are the copyright owner or authorized to act on behalf of the owner.

We will review notices of copyright infringement and take appropriate action. Inquiries not following this procedure may not be addressed.

B. If you believe content was removed or disabled incorrectly, you may submit a counter-notice with:

Your signature.
Identification of the content that was removed and its previous location.
A statement that you believe the content was removed due to a mistake.
Your contact information and a statement consenting to the jurisdiction of the federal courts in Richmond, VA.

C. Upon receiving your counter-notification, we will forward it to the party that originally filed the copyright infringement notice. By submitting a counter-notice, you consent to the disclosure of your information.

D. If no court action is taken within 10 days of the counter-notification, we may reinstate the content.

Third-Party Identification

You agree to indemnify and hold harmless I AM Power Auto Group and its affiliates from any claims, losses, damages, liabilities, and expenses arising from your use of our services or any third-party content provided by you through your account.

Warranties and Limitation of Liability

Use of our website and services is at your own risk. We are not responsible for content or data shared by third parties. Our services are provided "as is" and without any warranties, either express or implied. We do not guarantee the reliability, availability, accuracy, or security of our services.

To the fullest extent allowed by law, I AM Power Auto Group will not be responsible for indirect, special, incidental, or consequential damages, even if we were advised of the possibility. Our total liability for any claims is limited to the amount you paid us to use our services.

Dispute Resolution and Arbitration

Any disputes between us must first be discussed in writing. If not resolved within 30 days, they will be submitted to binding arbitration under the Federal Arbitration Act. We agree that any court actions must be filed in Richmond, VA.

No Class Actions

You agree that disputes will not be resolved on a class wide basis and that you waive the right to participate in class action suits.

No Jury Trials

You waive the right to a jury trial for any disputes that arise from using our services.

Amendments

I AM Power Auto Group may update these terms at any time, and it is your responsibility to review them. Updates will not apply retroactively.

Miscellaneous

These terms represent the entire agreement between you and I AM Power Auto Group. We may suspend or terminate access to our services at any time for any reason. We are not responsible for third-party websites linked from our site.
